4th anniversary

The Promotion is open to legal residents of the fifty (50) United States and District of Columbia, Canada, Australia, New Zealand, Japan, China, India, the United Kingdom, Ireland, Germany, France, Italy, and Spain (hereinafter “Eligible Areas”) who are 18 years of age or older (20+ in Japan) or who have reached the age of majority in their jurisdiction of residence as of the date of entry.

The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

Employees of mixi, Inc. (hereinafter referred to as "mixi") and its affiliates as well as the family members (spouse, parents, siblings and/or children) and household members of each employee are not eligible to enter.

Participation constitutes the entrant’s full agreement to these Rules and mixi's decisions, which are final in all Promotion-related matters.

Entrants must agree to the Promotion's rules and mixi's Privacy Policy.

Those who do not meet the requirements listed here are ineligible for entry into the Promotion's offer.

After the promotion ends, winners will be contacted via direct message from official FamilyAlbum accounts by April 10, 2019.

Amazon gift card winners will be sent a confirmation message upon winning. Those selected for the 4th Anniversary Movie will be asked for permission to use their footage. Both parties must respond to these messages within the following time periods or their entries will be withdrawn:

• Amazon gift card: within 10 days
• 4th Anniversary Movie: within 3 days

One person may enter as many times as they wish on Instagram, Twitter, and/or Facebook.

Entries made outside of the promotion period are ineligible.

Video entries posted without the designated hashtag are ineligible.

Underage entrants must have the permission of a parent or legal guardian before entering.

Due to privacy restrictions, any entries posted on private accounts cannot be viewed by mixi. To enter from a private account, you must either change your account to public or send your entry via direct message to an official FamilyAlbum account.

Entrants' submissions must be original and cannot infringe the copyright or other intellectual property rights of any third party. Any entry found to be copied, doctored, or amended will be disqualified. Any photographs posted for submission must have the consent of all individuals appearing within it.

Videos added to the 4th Anniversary Movie may be edited for length.

Amazon gift card winners will be randomly selected from all valid entries within 10 business days of the Promotion end date.

Entrants must agree that no content will be submitted that:

• Is known by you to be false, inaccurate, or misleading.
• Encourages or advocates any illegal or unauthorized behavior or activity; or violates any law, statute, ordinance, or regulation.
• Is offensive, obscene, vulgar, or is inappropriate for a public and family-friendly forum.
• Contains individuals smoking tobacco, consuming alcohol, or who appear to be under the influence of alcohol.
• Is (or could be considered to be) defamatory, libelous, hateful, racially or religiously biased or offensive, threatening, or harassing to any individual or entity.
• Includes any information that references other websites, addresses, email addresses, contact information, or phone numbers. Contains any computer viruses, worms, Trojan horses, or other potentially damaging programs or files.
• Infringes any third party’s copyright, patent, trademark, trade secret, rights of publicity, rights of privacy, moral rights, or any other personal or proprietary rights.

Entrants are solely responsible for the information they provide and views they express on their Instagram, Twitter, or Facebook account.

It is the responsibility of the winners to provide their correct and up-to-date information at the time of acceptance in order to receive their prize. mixi cannot be held responsible for winners who fail to do so.

mixi bears no responsibility for any Promotion-related damages incurred by entrants.

Winnings belong to the eligible winner and are not transferable to a third party or redeemable for cash.

mixi reserves the right to refuse to award a prize or disqualify a participant if there is reason to believe there has been a violation of these Rules or of any other Promotion instructions, or otherwise where a participant has gained unfair advantage or won using fraudulent means.

In the event of circumstances beyond mixi's control, mixi reserves the right to modify or suspend the Promotion or these Rules, in whole or in part, with or without notice. However, mixi will work to minimize the effect to participants in order to avoid undue disappointment.

mixi reserves the right of final decision regarding all promotional matters not described in these Terms.

All personal information given to mixi will be used only for promotional purposes and the sending of prizes. Please consult our Privacy Policy for more information.

Entries will be subject to Instagram's, Twitter's, or Facebook's terms of service, which are available online at www.instagram.com, www.facebook.com, and www.twitter.com.

The Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram, Twitter, or Facebook. You are providing your information to mixi, not to Instagram, Twitter, or Facebook. By entering the Promotion, all participants accept that they have no claim against Instagram, Twitter, or Facebook whatsoever, and agree to a complete liability release for Instagram, Twitter, or Facebook.

Content entrants submit to the Promotion may be reposted on mixi's official social media accounts (Instagram, Twitter, or Facebook). Each eligible entrant grants permission for mixi to use the contents of their entry for editorial, advertising, marketing and promotional purposes in the following forms of media in perpetuity, without compensation, notification, or permission:

• In the movie made from this promotion
• In this service's app
• On the mixi website
• On mixi's official social media accounts (Facebook, Instagram, Twitter, YouTube)
• In mixi's online ads

Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content, are theirs to assert. Participants warrant that the materials contain no copyrighted materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.

Amazon Gift Card winners and those selected for the 4th Anniversary Movie may have their nicknames and/or children's birthdays displayed in mixi's online content or social media accounts.

If any of these terms should be determined to be illegal, invalid, or otherwise unenforceable then it shall be deleted from these Rules and the remaining terms shall remain in full effect.

The Promotion and these Terms are governed by Japanese law and subject to the exclusive jurisdiction of the Japanese courts.

Amazon gift card winners will be asked to provide their shipping information. An Amazon.com, Amazon.ca, Amazon.co.uk, Amazon.com.au, Amazon.de, Amazon.fr, Amazon.it, Amazon.es, Amazon.in, Amazon.cn, or Amazon.co.jp gift card will be sent to the address they provide. These cards are valid for one (1) year from date of issue.
